YES. I believe most of crime cases in Spore happen at home. outside seems all safe day and night, but the evils are nicely hidden inside. rape by husband, father, stepfather, brothers...can't trust own family members completely anymore eh?

Old issue. Parliament debated this topic during the said major Penal Code review (2006-7).

Look, the enlightened world is moving towards total abolition, but martial rape itself is still a relatively new legal concept. Heck, academics are still undecided which system is best: judicially undermining martial immunity, or legislatively eliminating marital exemption. http://tinyurl.com/m58sq5 Makes sense to be cautious ("calibrated") & proceed in conjunction with societal progress.

The petition is also incorrect to claim there must be explicit prior legal arrangements to nullify marital immunity. To quote Ho Peng Kee's speech: "Sir, in addition, where there is a judgment of judicial separation or an interim judgment of divorce not made final...the wife need not be living separately from her husband as long as she is living apart from him, ie, they can still be living under the same roof but are essentially living in separate households. No, Ho Peng Kee's speech here is only referring to the "living apart" aspect of the requirement. If you look at the law "living apart" is not enough, you must have taken steps to obtain a separation, divorce, protection order etc. AND be living apart.

SG law still recognizes petition proceedings, not just writ proceedings. (Forgot the application deadlines for each.)

What Prof. Ho clarified was that "living apart" need not equate "living separately", i.e. in another house. Conversely, you're opting for the literal (narrow) interpretation -- which, in hindsight, I guess everyone would associate with if they haven't seen/remembered the speech.
